Gift Voucher Terms

These Gift Card Terms govern the use of CAMILLA gift vouchers and gift cards and constitute a binding legal agreement between CAMILLA Australia Pty Ltd (ACN 135 300 382) (CAMILLA, we or us) and the person purchasing, redeeming, attempting to redeem or otherwise in possession of a Gift Voucher (you). These Terms are to be read in conjunction with our Terms and Conditions and our other terms or policies available on our website from time to time at www.camilla.com

We ask that you read these Gift Card Terms carefully before purchasing, redeeming or attempting to redeem a Gift Card. By purchasing, redeeming or attempting to redeem a Gift Card, you warrant and represent to CAMILLA that you have read and agree to be bound by these Gift Card Terms. If you are giving a Gift Card as a gift, it is your responsibility to ensure that the recipient is aware of these Gift Card Terms.

Expiry and Validity

1. Gift Vouchers issued after March 2018 expire three (3) years after the date of issue of the Gift Voucher, irrespective of when a recipient of a Gift Voucher may receive the Gift Voucher (Expiry Date). Gift Vouchers issued prior to March 2018 will have the relevant expiry dated listed on the card.
2. Gift Vouchers are not valid after the Expiry Date and any amounts remaining or unused on the Gift Voucher are non-refundable.
3. When a Gift Voucher reaches a zero (0) balance, it is no longer valid.
4. For the validity of the Gift Voucher, there are no limitations on the number of transactions for which the Gift Voucher may be used – other than once the total value of the Gift Voucher has been spent.
5. All Gift Vouchers remain property of CAMILLA. Expired Gift Vouchers may be destroyed by you or returned to CAMILLA.
6. Taxes are still applicable on any products purchased with a Gift Voucher and will be included in the purchase price and deducted from the Gift Voucher. All Gift Voucher amounts are in Australian Dollars.
7. Gift Vouchers are non-reloadable and may not be redeemed for cash. Gift Vouchers are not legal tender, account/credit/debit cards or securities and no transaction statements will be sent to you regarding your Gift Voucher.
8. You are not permitted to sell your Gift Voucher and you cannot obtain any cash advance with your Gift Voucher.

Purchase of a Gift Voucher

1. Gift Vouchers may be purchased with cash or by credit card instore, and with valid payment options online and will be loaded in the denomination set out on the Gift Voucher.
2. Once a Gift Voucher has been successfully purchased, the date of issue of the Gift Voucher will be recorded on the Gift Voucher, and/or the receipt of purchase, and the Gift Voucher will be activated.
3. Gift Vouchers are generally excluded from sale promotions and discounts unless otherwise specified by CAMILLA. Gift Vouchers cannot be purchased using coupon codes or discounts.
4. There may be a delay with the activation of the Gift Voucher after purchase, whereby purchases or balance enquiries may not be made for a period of time. CAMILLA will not be responsible for such delay or any losses or damage arising from such delay.

Redemption on Purchases and Participating Stores

1. Physical Gift Vouchers may be redeemed on purchases at participating CAMILLA boutique retail stores only (Participating Stores), subject to the exclusions below.
2. Participating Stores: All CAMILLA boutique retail stores in Australia are Participating Stores. Physical Gift Vouchers cannot be redeemed online or with any CAMILLA stockists such as David Jones department stores.
3. eGift Cards may be redeemed on purchases at camilla online at au.camilla.com, subject to the exclusions below.
4. eGift Cards cannot be redeemed in CAMILLA boutiques or with any CAMILLA stockists such as David Jones department stores.
5. Excluded purchases: Gift Vouchers cannot be redeemed for the purchase of other Gift Vouchers.

Redemption

1. To redeem a Physical Gift Voucher, you must present the Physical Gift Voucher at the point of sale with the products that you wish to purchase, at the time of purchase. Our sales assistant will provide instructions or will assist you to swipe, scan or enter details your Gift Voucher into our system and enter the PIN code located on the reverse of the Gift Voucher.
2. eGift Card, can be redeemed by entering the Gift Card number when prompted at the checkout. A maximum of five eGift cards can be used to shop in one transaction online.
3. You agree that by redeeming a Gift Voucher, you authorise us to reduce the amount on your Gift Voucher by the value of the purchase. By redeeming a Gift Voucher, you agree that you are making a purchase subject to our Sale Terms and Conditions.
4. If a purchase does not exceed the amount of the Gift Voucher, any remaining amounts will remain on the Gift Voucher and may be used on future purchases, valid to the same Expiry Date. Change will not be given for any remaining amounts on a Gift Voucher. If a purchase exceeds the value of the Gift Voucher, the remaining amount must be paid for using another payment method, such as cash or debit/credit card.

Balance

1. You can check the remaining balance on your Physical Gift Voucher by presenting the Gift Voucher and asking a sales assistant in-store.
2. CAMILLA eGift Cards can be verified on request or at time of purchase online or by contacting Customer Service
3. No change is given and any balance that remains on the card can only be used in whole or part against future purchase.
4. CAMILLA Gift Cards expire 36 months after purchase unless stated on the back of the Gift Card. Any balance that remains on the card after expiry will not be available for use.

Returns of purchases

1. Products that are purchased wholly or partially with a Gift Voucher may only be exchanged or returned in accordance with our Returns Policy.
2. Where a refund is issued for a product purchased wholly or partially with a Gift Voucher, you agree that any part of the purchase made by Gift Voucher may be refunded in the form of CAMILLA Retail Boutique or CAMILLA eBoutique credit of the equivalent amount instead of other tender. Any amounts paid by other tender will be refunded in the same tender to the same account in which the purchase was made.

Returns or exchanges of Gift Vouchers

1. Gift Vouchers cannot be exchanged for a different denomination of Gift Voucher or for another tender, cash or discount.
2. Gift Vouchers cannot be returned for change of mind. CAMILLA will accept returns in accordance with our Returns Policy and the Australian Consumer Law where a Gift Voucher is faulty or damaged as a result of a manufacturing defect or otherwise due to CAMILLA’s fault. CAMILLA does not offer returns where a Gift Voucher is damaged due to fault of your own.

Lost or stolen vouchers

1. CAMILLA is not responsible if a Gift Voucher is lost, stolen, destroyed or used without permission.
2. Gift Vouchers will not be replaced or refunded if they are lost or stolen or used without permission.
3. If a Gift Voucher is reported stolen, CAMILLA reserves the right to cancel or void a Gift Voucher.

Cancellations and alterations

1. Once issued, you cannot cancel a Gift Voucher except if used, expired or otherwise cancelled by CAMILLA.
2. CAMILLA reserves the right to cancel, void or alter the balance of a Gift Voucher at any time without notice to you, where a Gift Voucher is:
   1. used for illegal purposes;
   2. defrauded;
   3. stolen;
   4. defaced or mutilated;
   5. altered;
   6. issued in error; or
   7. otherwise tampered with in any way.
3. Where CAMILLA has cancelled or voided a Gift Voucher due to the fault of CAMILLA, CAMILLA will issue you with a refund or replacement Gift Voucher or a refund of the purchase price at CAMILLA’s election.

Privacy

1. Our Privacy Policy applies to our collection of your personal information in relation to Gift Vouchers. Please ensure to read our Privacy Policy.

Limitation of Liability

1. You agree that you are responsible for the use and protection of your Gift Voucher and that you are liable for all transactions on your Gift Voucher, except to the extent that there has been fraud or negligence by CAMILLA.
2. You have certain rights under the Australian Consumer Law which cannot be excluded and are not affected by these Gift Voucher Terms. To the maximum extent permitted by law, CAMILLA excludes all other liability whatsoever to you arising out of or in any way connected with these Gift Voucher Terms or your purchase or use of a Gift Voucher, including any liability for consequential or indirect losses of any kind, loss of profit, revenue or goodwill, howsoever arising and whether caused by breach of statute, breach of contract, negligence or other tort.
3. To the extent permitted by law, our maximum aggregate liability to you is limited to the purchase price of your Gift Voucher.

Variation and waiver

A provision of these Gift Voucher Terms or a right created under it, may not be waived or varied except in writing with the consent of each of the parties.

Severability

Any provision of these Gift Voucher Terms that is prohibited or unenforceable in any jurisdiction is to be severed from these Gift Voucher Terms in that jurisdiction to the extent of the prohibition or unenforceability. Such severability does not invalidate the remaining provisions of these Gift Voucher Terms nor affect the validity or enforceability of that provision in any other jurisdiction.

Governing Law

These Gift Voucher Terms are governed by the law of NSW. Each party submits to the exclusive jurisdiction of courts exercising jurisdiction there in connection with matters concerning these Gift Voucher Terms.

Amendments

1. These Gift Voucher Terms may be amended from time to time by CAMILLA and the latest version will be published on the CAMILLA website. It is your responsibility to keep up to date with these Gift Voucher Terms.
2. If you do not agree with such amendments, you may contact us within two (2) weeks of us publishing the amended Gift Voucher Terms and we will cancel and refund your Gift Voucher or provide an alternate resolution.
3. Any amendments to these Gift Voucher Terms will apply to all Gift Vouchers purchased or redeemed after the amendment date.
